Representative Marumoto Testifies for Kawamoto's Compliance

Representative Barbara Marumoto testimony to the Honorable Barbara Marshall and Members of the Honolulu City Council, scheduled for Wednesday, October 1, 2008 at 1p.m., favors resolution 08-218, which urges the Consulate General of Japan in Honolulu to request Mr. Genshiro Kawamoto's compliance with Kahala's property covenants and restrictions.

Representative Marumoto's testimony follows:

'Residents of Kahala must comply with the covenants and restrictions first established many years ago by the developer, Bishop Estate/Kamehameha Schools. After residents purchased their land in fee, they (through the Kahala Community Association) agreed to retain these rules in order that the neighborhood remains an attractive place to live.

Mr. Kawamoto has not followed these regulations to the letter. In many cases he knocked down walls, dumped the rubble in swimming pools, but left the remnants of the walls in place. His properties are not well-maintained. Most of the lots are overgrown with weeds. Where once happy families lived, many of the houses are vacant and hollow.

Kahala is one of the most beautiful residential areas in Honolulu and houses sell for a pretty penny. But the large number of Mr. Kawamoto's homes and the lack of upkeep will reduce property values in the neighborhood.

Whenever complaints have arisen about possible standing or stagnant water in the bottom of pools and possible vermin at certain addresses, I have asked the Vector Control Section of the Department of Health to inspect the premises. The DOH has been responsive to my requests and has not found any problems thus far; however, the department has not inspected all of Mr. Kawamoto's properties.

Resolution 08-218 asks that the Consulate General of Japan use its good offices to communicate with and persuade Mr. Kawamoto to maintain his properties in Kahala. I heartily endorse this approach as other remedies in the law, to the best of my knowledge, do not exist. Mahalo for your consideration.
