REGULAR MEETING MINUTES DRAFT

WEDNESDAY, JULY 14, 2021

VIRTUAL WEBEX MEETING

CALL TO ORDER: Chair Frost called the meeting to order at 7:00 p.m. Quorum WAS NOT ESTABLISHED with six (6) members present. Note - This 13-member board requires seven (7) members to establish a quorum and to take official Board action.

Board Members Present: Joshua Frost, Randy Hack, Juanita Kawamoto, Beverly Mau, Darlene Nakayama, Rusti Onishi (arrived at 7:07 p.m.), Benton Pang, Derek Turbin, Earl Shiraki, Dean McColgan (appointed at 7:50 p.m.), and Jesus Arriola (appointed at 7:50 p.m.).

Board Members Absent: None.

Guests: Captain Nilo Melo (Honolulu Fire Department); Lieutenant Taro Nakamura, Sergeant Adam Lipka (Honolulu Police Department); Dominic Dias (Board of Water Supply); Councilmember Calvin Say; Representative Jackson Sayama; Malia Harunaga (Hawaii Bicycle League); Alex Kozlov (Department of Design and Construction); Sidney Lynch, Steve, Stacie Robinson, Laurie (Residents); Lindon Valenciano (Neighborhood Assistant) were among the 31 total in attendance.

ELECTION OF OFFICERS TO SERVE FROM JULY 1, 2021 TO JUNE 30, 2022: Quorum WAS NOT established. Item was deferred.

CITY MONTHLY REPORTS

Honolulu Fire Department (HFD): Captain Nilo Melo reported the following:

• June 2021 Statistics: 1 cooking fire, 25 medical calls, 1 motor vehicle crash collision, 4 mountain rescues.

• Safety Tips: Grilling safety tips were provided.

Questions, comments, and concerns followed: Rescue: Shiraki noted there were a lot of rescues and suggested charging a fee. Captain Melo replied that many people overestimate their abilities and/or are unprepared for hiking.

Mau and Kawamoto entered the meeting at 7:03 p.m.; eight (8) members present. QUORUM WAS ESTABLISHED.

Honolulu Police Department (HPD): Lieutenant Taro Nakamura reported the following:

• June 2021 Statistics: 4 motor vehicle thefts, 7 burglaries, 20 thefts, and 10 unauthorized entries into a motor vehicle (UEMV), and 8,111 total calls for service. More information can be found at www.honolulupd.org.

• Safety Tip: Business security tips were provided.

Onishi entered the meeting at 7:07 p.m.; nine (9) members present.

Questions, comments, and concerns followed:

1. Expired Tags: Resident Dean McColgan inquired and Lieutenant Nakamura replied that it is illegal to have expired safety check and registration, so any infraction in enforceable.

2. Dog Attack: Kawamoto reported a dog from an unfenced yard attacked and killed another dog on 10th Avenue, noting that nothing was done after court. Lieutenant Nakamura shared the process that after the owner is cited, it goes in the direction of the Humane Society and suggested to request an investigator. Turbin inquired and Kawamoto replied that they have spoken to the prosecutor, however feels that the system is not doing its job. Onishi inquired and Kawamoto replied that there is a bench warrant for the owner in order to initialize the processing the dog.

3. Billy Club: Shiraki suggested that HPD carry billy clubs while on patrol.

4. Contact: Sergeant Adam Lipka suggested contacting him so that they may discuss this issue in depth.

Board of Water Supply (BWS): Dominic Dias reported the following:

• June 2021 Main Breaks: 4-inch main break at Holomua Place.

• General Water Announcements: Water Conservation: Water conservation tips were provided.

Questions, comments, and concerns followed:

1. Red Hill: Shiraki noted that the Red Hill tanks need to be moved to protect the drinking water. Dias encouraged everyone to visit BWS's website to educate and make their own decisions.

2. Roosters: Hack requested checking into feral roosters at the Keanu pumping station.

Hearing no objections, the Board returned to Agenda Item ELECTION OF OFFICERS TO SERVE FROM JULY 1, 2021 TO JUNE 30, 2022 CITY.

Chair: Mau NOMINATED Frost for Chair. Hearing no other nominations, Chair Frost was ELECTED as Chair by UNANIMOUS CONSENT; 9-0-0 (Aye: Frost, Hack, Kawamoto, Mau, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

Vice Chair: Shiraki NOMINATED Mau for Vice Chair. Hearing no other nominations, Mau was ELECTED as Vice Chair by UNANIMOUS CONSENT; 9-0-0 (Aye: Frost, Hack, Kawamoto, Mau, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

Secretary: Mau NOMINATED Nakayama for Secretary. Hearing no other nominations, Nakayama was ELECTED as Secretary by UNANIMOUS CONSENT; 9-0-0 (Aye: Frost, Hack, Kawamoto, Mau, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

Treasurer: Shiraki NOMINTED Onishi for Treasurer, Onishi declined. Mau NOMINATED Hack for Treasurer. Hearing no other nominations, Hack was ELECTED as Treasurer by UNANIMOUS CONSENT; 9-0-0 (Aye: Frost, Hack, Kawamoto, Mau, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

Sergeant-at-Arms: Mau NOMINATED Shiraki for Sergeant-at-Arms. Hearing no other nominations, Shiraki was ELECTED as Sergeant-at-Arms by UNANIMOUS CONSENT; 9-0-0 (Aye: Frost, Hack, Kawamoto, Mau, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

BOARD BUSINESS RELATED TO INITIAL CONVENING:

Meeting Determination--Date, Time, Location (July 1, 2021 To June 30, 2022): Hearing no objections, the Board will continue to meet every 2nd Wednesday of the Month at 7:00 p.m. at a location to be determined.

Determination Of Board Recess Schedule (July 1, 2021 To June 30, 2022): Hearing no objections, the Board will retain the recess schedule in September 2021, January 2022, and June 2022.

Request To Participate In The Olelo Broadcast Program Or To Request Funds For An Annual Newsletter: Hearing no objections, the Board will continue participating in the Olelo broadcast program.

Adoption of Oral Testimony Rules: Hearing no objections, the Board retained the oral testimony rules listed on the agenda of three (3) minutes.

REPORTS OF MEMBERS ATTENDANCE AT OTHER PUBLIC MEETINGS: None.

FILLING OF VACANT BOARD SEATS: There is one (1) vacancy in Subdistrict 2, one (1) vacancy in Subdistrict 3, and two (2) in Subdistrict 4.

Subdistrict 4: Dean McColgan volunteered for Subdistrict 4. Mau NOMINATED and Onishi SECONDED McColgan for Subdistict 4. Hearing no other nominations for Subdistrict 4, McColgan was APPOINTED to Subdistrict 4 by UNANIMOUS CONSENT; 9-0-0 (Aye: Frost, Hack, Kawamoto, Mau, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

Subdistrict 3: Jesus Arriola volunteered for Subdistrict 3. Mau NOMINATED and Turbin SECONDED Arriola for Subdistict 4. Hearing no other nominations for Subdistrict 4, Arriola was APPOINTED to Subdistrict 3 by UNANIMOUS CONSENT; 9-0-0 (Aye: Frost, Hack, Kawamoto, Mau, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

McColgan and Arriola entered the meeting at 7:50 p.m.; 11 members present.

ELECTED OFFICIALS

Councilmember Calvin Say: Councilmember Say shared the newsletter regarding Palolo District Park Americans with Disabilities Act (ADA) renovations, weight room concerns, Lamaku Place road, Lai Road guardrails, 9th Avenue monster home cited, and prepaid kiosks at 11th and Waialae Avenues.

Questions, comments, and concerns followed:

1. Monster Homes: Shiraki inquired and Councilmember Say replied that the home had unpermitted additions. Onishi noted that the issue with monster homes is that they are like apartments.

2. Golf: Shiraki inquired and Councilmember Say replied that there has been no Top Golf discussion. Shiraki inquired when the City will return to pre-COVID golf procedures by allowing walk-in and stand-by play.

3. Zonings: McColgan requested a land use designation and zonings presentation for Palolo Valley. Onishi suggested a summary for Palolo Valley zoning.

4. Project Update: Shiraki inquired and Councilmember Say replied that he invited the Department of Design and Construction (DDC) Director Alex Kozlov for Kuahea/Waiomao land stabilization updates.

Mayor Rick Blangiardi's Representative: No representative present, no report given. Councilmember Say shared that the Board used to have a Mayor's representative, but that representative is no longer with the City.

Governor David Ige's Representative: Catherine Awakuni-Colon shared the newsletter which highlighted the vaccine campaign, eviction moratorium expiring, Bill 1376 for mediation process partnerships, and Kaukau 4 Keiki.

Questions, comments, and concerns followed:

1. HPD Support: Shiraki recommended that the Governor provide support to HPD, recognize the UH sports department, and provide the deserved funding for teachers.

2. Exemption: Turbin thanked Awakuni-Colon for the vaccine exemption update.

3. Limit Travel: Shiraki suggested limiting US travel and stringent consequences for violations.

4. Vaccine: Mau inquired and Awakuni-Colon replied that they track vaccines ordered and administered.

5. Unemployment Insurance (UI): Chair Frost requested updates for UI or if they are planning to expand.

Representative Jackson Sayama: Representative Sayama provided legislative updates such legislature special session to address the Governor vetos with overrides and amendments, illegal monster home development, and Aliiolani Elementary School's Kaimuki Kaukau event on Friday, July 16, 2021 from 5:00 p.m. to 9:00 p.m.

Questions, comments, and concerns followed:

1. Clarification: Shiraki inquired and Representative Sayama clarified that the event is this Friday.

2. Budget: Resident Sidney Lynch thanked the Representative for providing the City budget in the newsletter.

3. Monster Homes: Onishi noted that monster homes begins with the Department of Planning and Permitting (DPP) and Representative Sayama replied that the DPP needs work to improve.

4. Survey: McColgan inquired and Representative Sayama replied that they have been canvassing because it is valuable, however they are working on an online survey.

5. Inspectors: Shiraki suggested that inspectors conduct visits later to contact the residents after work. Onishi inquired if inspectors can enter a house to inspect.

6. Passing: Representative Sayama noted the passing of Jimmy Chun and shared donation information.

Senator Les Ihara Jr.: No representative present. No report given.

RESIDENTS/COMMUNITY CONCERNS:

Ala Wai Flood Mitigation: Resident Lynch inquired about the US Army Corps of Engineers (ACE) Ala Wai flood mitigation project and Kozlov noted that the City is authorized to relook at the project and to visit all options. Resident Lynch inquired and Kozlov replied that it is up to the Office of Management and Budget (OMB) to decide funding extension when the project is designed. Resident Steve requested that the community is included in the process prior to decision making. Resident Lynch inquired and Kozlov replied that there are not currently looking for a replacement firm but Oceanit is part of the discussion.

PRESENTATIONS

Hawaii Bicycle League (HBL) Presentation: HBL representative Malia Harunaga shared the physical, mental, and environmental benefits to riding bikes, announced HBL programs, illustrated how to travel for the safest ride, and reminded motorists that the three (3) feet minimum distance when passing a cycler is the law.

Questions, comments, and concerns followed:

1. Danger: Shiraki noted that there are many cars and it is dangerous to ride in the middle of the road.

2. Sign Up: Mau inquired and Harunaga shared how to sign up for programs like the 3-wheel bike riding.

3. Motorized Scooters: Mau inquired and Harunaga replied that micro mobility devices/vehicles are currently being discussed.

Waiomao & Kuahea Slide Website Walkthrough: Kuahea/Waiomao resident Stacie Robinson shared the community-based Kuahea/Waiomao Slide website that shares the community members affected, a blog monitoring progress, and resources such as media reports, City correspondence, resolutions, and documents like the Geolab reports.

Hack left the meeting at 9:25 p.m.; 10 members present.

Questions, comments, and concerns followed:

1. Input: Chair Frost inquired and Robinson replied that one can provide input by filling the contact form in the Take Action tab.

2. Impressive: Onishi and Hack noted that the website is impressive.

3. Delay: Onishi inquired and Robinson shared that residents have strong and raw feelings about the delay.

4. Responsibility: Resident Lynch noted that the City is not taking responsibility for other properties and not settling. Shiraki inquired what the solution for this issue is.

5. Project Update: DDC Director Kozlov provided an update and reported that they are continuing with the stabilization project on Phase 2 and will repair the roads and sidewalks below Phase 2. Kozlov noted that the responsibility of the City is to protect the infrastructure and there is no undermining caused by the City.

6. Unstable: Resident Laurie inquired and Kozlov replied that the sewer and water lines were separated because of the slide.

7. Website: Chair Frost noted that this is not the space for this conversation because they are discussing the website. Kozlov recommended visiting the DDC website because it is updated regularly and answers many of the questions asked. Resident Lynch and Kozlov agreed to meet with residents via Zoom.

8. After Phase 2: Resident Laurie inquired and Kozlov replied that based on the results of Phase 2, they will fix Waiomao Road in hopes that it will be restored back.

9. Mediate: Turbin noted that someone on the Board would be willing to mediate the meeting if needed.

Mau MOVED and Onishi SECONDED the Motion to Approve the Minutes from Wednesday, May 12, 2021 Meeting as written. The Motion PASSED by UNANIMOUS CONSENT, 10-0-0; (Aye: Arriola, Frost, Kawamoto, Mau, McColgan, Nakayama, Onishi, Pang, Turbin, Shiraki; Nay: none; Abstain: none).

Treasurer's Report: This item was deferred.
