REGULAR MEETING MINUTES DRAFT

WEDNESDAY, FEBRUARY 8, 2023

REMOTE WEBEX MEETING

PUBLIC LOCATION: KAPALAMA HALE CONFERENCE ROOM 277

CALL TO ORDER: Chair Frost called the meeting to order at 7:00 p.m. Quorum WAS ESTABLISHED with eight (8) members present. Note - This 13-member board requires eight (8) members to establish a quorum and to take official Board action.

Board Members Present: Dean McColgan, Joshua Frost, Randy Hack, Juanita Kawamoto, Darlene Nakayama, Rusti Onishi, Earl Shiraki, Derek Turbin (7:29 p.m.), Colin Scott Peros and Dallas Ige (appointed at 7:26 p.m.).

Board Members Absent: Beverly Mau.

Guests: Sergeant Rance Okano (Honolulu Police Department); Dominic Dias (Board of Water Supply); Councilmember Calvin Say; Warren Mamizuka (Mayor Blangiardi's Representative); Representative Jackson Sayama; Senator Les Ihara Jr.; Peter Savio, Ranell Asuega (Residents); Lindon Valenciano (Neighborhood Commission Office). There were 45 total in attendance. Name not included if not legible on sign-in sheet, not signed in, not participated in discussion and/or not stated for the record.

CITY MONTHLY REPORTS

Honolulu Fire Department (HFD) (00:00:00): No representative present. Written report submitted:

• January 2023: 2 activated alarms, 28 medicals, 1 motor vehicle crash/collision.

• Safety Tip: Lithium-ion battery safety tips were provided.

Honolulu Police Department (HPD) (00:01:06): Sergeant Rance Okano reported the following:

• January 2023: 8 motor vehicle thefts, 8 burglaries, 18 thefts, and 6 unauthorized entries into motor vehicle (UEMV). 8,464 total calls.

• Safety Tip: Safe driving in the rain tips were provided.

Questions, comments, and concerns followed:

1. Speeding: Shiraki reported speeding concerns on 10th Avenue, inquired and Sergeant Okano confirmed reporting vehicle licenses of speeders will help with enforcement.

2. Fireworks: Kawamoto reported fireworks incident continuing at the 1900 block of 10th Avenue, inquired and Sergeant Okano replied there were 2-3 reports and officers were dispatched. Shiraki echoed the sentiment. Kawamoto inquired and Sergeant Okano shared the enforcement process for fireworks.

Board of Water Supply (BWS) (00:08:18): Dominic Dias reported there were no main breaks and shared the general announcements regarding rebates for high efficiency toilets.

Questions, comments, and concerns followed: Water Concerns: Kawamoto expressed Red Hill concerns where the water from Moanalua to Hawaii Kai is affected. Dias noted P lolo's water comes from the Beretania/Kaimuk well but BWS supports residents and Lau to protect the aquifer.

REPORTS OF MEMBERS ATTENDANCE AT OTHER PUBLIC MEETINGS (00:13:39): None.

FILLING OF VACANT BOARD SEATS (00:14:01): There is one (1) vacancy in each: Subdistrict 2, Subdistrict 3, and Subdistrict 4. Dallas Ige volunteered for Subdistrict 2 and introduced himself sharing a brief background. Neighborhood Assistant (NA) Lindon Valenciano verified Ige's residence. Nakayama NOMINATED, Shiraki SECONDED Ige for Subdistrict 2. Ige was APPOINTED by UNANIMOUS VOTE.

Chair Frost called a brief recess for Ige to recite the Oath of Office at 7:25 p.m.

Valenciano administered the Oath of Office to Ige at 7:26 p.m.

Chair Frost called the meeting back to order at 7:27 p.m.; nine (9) members present.

ELECTED OFFICIALS

Congressman Ed Case: No representative present. No report given.

Turbin entered the meeting at 7:29 p.m.; 10 members present.

Councilmember Calvin Say (00:24:44): Councilmember Say reported regarding the Kuahea/Waiomao stabilization project, P lolo District Park clean-up, P lolo Avenue cement slab sidewalk, Sasaki boulder incident, and Bill 57.

Questions, comments, and concerns followed:

1. Pool: Hack inquired and Councilmember Say confirmed the P lolo District Park swimming pool is open.

2. Topgolf: Shiraki inquired and Councilmember Say replied the Department of Enterprise Services (DES) is no longer discussing Topgolf in Honolulu.

3. Illegal Rentals: Shiraki inquired and Councilmember Say reported unauthorized rentals at Mokuna Place.

4. Gym: Resident Ranell Asuega asked and Councilmember Say will share the P lolo District Park gym hours.

5. Lights: A resident inquired and Councilmember Say suggested contacting him because he has reached out to a number of people to reinstall the lights for the P lolo District Park outdoor courts and field.

Mayor Rick Blangiardi's Representative (00:32:49): Warren Mamizuka reported follow-ups from the prior meeting:

• Widening Turn on Wai alae Avenue: The Department of Transportation Services (DTS) will conduct an investigation requiring research and field assessment regarding widening the left turn, yellow strip. DTS will take appropriate action as warranted by our analysis and will contact Mr. Shiraki.

• Restriping Wai alae Avenue: DTS conducted an investigation and determined this request should be reassigned to Department of Facility Maintenance (DFM). DFM has initiated Service Request #44800 to restripe the indicated section of Waialae Avenue. Request will be completed once resources are available.

Questions, comments, and concerns followed:

1. Contact: Shiraki shared his phone number so DTS can get in contact with him regarding Wai alae Avenue.

2. Park Lights: Residents and DFM representatives present discussed the possible actions to take depending if there is an existing system there that just needs to be reinstalled or if a new system needs installation. They will need to verify with the Department of Parks and Recreation (DPR). Residents reported the pool lights have been on 24 hours a day. Mamizuka will follow-up with timer. Onishi asked how long has it been without lights. Mamizuka will follow-up.

Governor Josh Green's Representative (00:40:03): Department of Land and Natural Resources (DLNR) Communications Specialist Ryan Aguilar introduced himself and was available for questions. Aguilar noted the Governor's focuses are homelessness, Kauhale tiny homes community, visitor impact fees, and the cost of living.

Questions, comments, and concerns followed: Housing Funds: Peros asked how much of the $10 million allocated to the City is being used in P lolo and Councilmember Say replied the funds will be used to subsidize various affordable housing projects on the island under Bill 7. Kawamoto asked and Councilmember Say replied the number of units depends on the developer, but they will be walk-ups to reduce elevator costs. Aguilar will follow up.

Representative Jackson Sayama (00:47:52): Representative Sayama provided bill updates regarding e-cigarettes/flavored vapes and redeveloping the Queen Lili uokalani Elementary School property. Representative Sayama reported a clean-up project in the works and has participated in a couple clean-ups.

Questions, comments, and concerns followed:

1. Gambling: Shiraki opposed legal gambling bills and Representative Sayama noted a measure introduced to legalize a limited form of gambling like sports betting was deferred in committee.

2. Marijuana: Shiraki opposed legal marijuana use and Representative Sayama noted the House's Health Committee took a look at a number of marijuana legislation. Kawamoto agreed with Shiraki because it is a step-up drug toward harder drugs and noted the homelessness leading causes are addiction and mental health. Representative Sayama acknowledges their positions but does not want to broadly characterize it and added there is a lot of work for consideration.

3. Electric Vehicles: Onishi inquired and Representative Sayama replied electric vehicle owners can opt-into a road usage charge based on milage instead of the $50 yearly tax, which could end up saving them money. Onishi expressed concerns of the continuous increase of taxes and fees.

4. Funding: Peros inquired and Representative Sayama replied he introduced the bill for a feasibility study for Queen Lili uokalani Elementary School for public input while laying the groundwork of its redevelopment. Peros suggested a provision that requires the School Facilities Authority to collaborate with the University of Hawai i Community Design Center.

5. Carbon Credit Offset Program: Kawamoto inquired about carbon credit off set programs instead of taxing those doing the right thing by owning electric vehicles. Representative Sayama requested Kawamoto reach out to share more information on the program.

6. Sports Wagering: Chair Frost noted House Bill 304 regarding sports wagering was heard but was deferred.

Senator Les Ihara Jr. (01:16:00): Senator Ihara shared the first major deadline for the session is Friday, February 17, 2023 and provided bill updates regarding funding publicly financed elections.

Questions, comments, and concerns followed:

1. Parakeet: Peros requested the parakeet legislation be referred again so that it is not a joint bill. Senator Ihara will check into it. Peros expressed gratitude for introducing bills to reduce invasives species.

2. Outreach: Kawamoto inquired and Senator Ihara replied they would need to identify areas and reach out to the various organizations and groups to fill the Neighborhood Board vacancies. Senator Ihara inquired and NA Valenciano replied candidates who filed for the next Neighborhood Elections are found online.

RESIDENTS/COMMUNITY CONCERNS: None

PRESENTATION:

Peter Savio & Caroline Sasaki on The Issue of Falling Rocks in P lolo (01:25:18): Peter Savio, land owner of the slope, illustrated the Sasaki property where the boulder fell into was the 3rd house from the slope. Savio noted that no singular party is to blame for the incident, however they need to work together with the State and the City to develop a solution because the current required fence would be inadequate. Savio had intended to turn that area into a native forest as he had done in Waikele.

Questions, comments, and concerns followed:

1. State Action: Representative Sayama inquired about State action for a solution and Savio clarified both the State and City is responsible for allowing development in these areas. Senator Ihara noted, according to DLNR, it is the landowner's responsibility. Senator Ihara offered to connect Savio with the Board of Land and Natural Resources (BLNR).

2. Ownership: Peros inquired and Savio noted he had tried giving the land to DLNR but no one wants it.

3. Solution: Shiraki inquired and Savio replied the solution would be working together with the government to install mitigation measures and build tall rock mitigation fences.

4. Documents: Representative Sayama requested that Savio send them the documents where the property was offered to the State. Savio will check the record.

BOARD BUSINESS

Approval of Minutes from Wednesday, December 14, 2022 (01:44:24): Hack MOVED, Nakayama SECONDED the Motion to Adopt the Wednesday, December 14, 2022 meeting minutes as presented. Hearing no objections or abstentions, the minutes were ADOPTED by UNANIMOUS CONSENT.

Consideration of Resolution Urging the Legislature to Address Community Concerns Over Public Safety, Government Waste, And Statutory Inconsistency in Felony Prosecutions as a Result of The State V. Obrero Decision (01:45:08): Chair Frost noted this resolution urges legislature to address community concerns of public safety which was talked about in December 2022. Chair Frost noted amending it for the current session since the previous resolution called for a special session.

Questions, comments, and concerns followed: Legislature: Hack inquired and Representative Sayama replied Senate Bill (SB) 36 and companion House Bill (HB) 810, which was referred to the Judiciary and Hawaiian Affairs (JHA) Committee, were introduced to address this issue. Chair Frost clarified SB 36 is moving and HB 810 was singly referred to the JHA Committee so it has more time. Hack recommended the resolution be deferred since there currently is legislative movement.

Hack MOVED, McColgan SECONDED the Motion to Defer the Resolution Urging the Legislature to Address Community Concerns Over Public Safety, Government Waste, And Statutory Inconsistency in Felony Prosecutions as a Result of The State V. Obrero Decision. Hearing no objections or abstentions, the Motion was ADOPTED by UNANIMOUS CONSENT.

Consideration of Meetings Moving Forward (Continue Meeting Virtually, Return In-Person at P lolo Elementary School, or Hybrid at P lolo Elementary School) (01:54:21): NA Valenciano noted P lolo Elementary School is no longer available for the remainder of the term. Chair Frost noted meeting remotely for the remainder of the term.

Neighborhood Board Elections (1:56:47): Chair Frost announced the 2023 Neighborhood Elections and noted he will not be running as a candidate for the 2023 Neighborhood Board Elections to focus on a new job.
